A&E Freedom Escapes – Mobile Messaging Terms & Conditions

These Mobile Messaging Terms & Conditions (“SMS Terms”) govern SMS and MMS text messaging programs operated by or on behalf of A&E Freedom Escapes LLC, doing business as A&E Freedom Escapes (“AEFE,” “we,” “our,” or “us”).

These SMS Terms apply to text messages sent by or on behalf of AEFE to mobile telephone numbers enrolled in or otherwise receiving communications through an AEFE mobile messaging program.

By affirmatively opting in to an AEFE mobile messaging program, you agree to these SMS Terms with respect to the category of communications described to you at the time you enroll.

Consent to receive promotional or marketing text messages is not required as a condition of purchasing an AEFE membership, travel booking, product, service, or other offering.

Merely providing AEFE with a mobile telephone number does not, by itself, constitute consent to receive promotional or marketing text messages.


1. Geographic Availability of AEFE Memberships

AEFE does not currently offer, accept applications for, or sell AEFE memberships to residents of the following states:

  • California

  • Florida

  • Hawaii

  • Kentucky

  • Maryland

  • Missouri

  • Nevada

  • New Hampshire

  • North Carolina

  • South Dakota

  • Vermont

  • Virginia

  • Washington

AEFE’s membership-focused promotional text messaging program is therefore not intended for residents of these states.

Eligibility is generally based on a person’s state of legal residence, not solely on the area code associated with a mobile telephone number, an IP address, or the person’s temporary physical location.

AEFE may request or use state-of-residence information to determine whether an individual is eligible to enroll in an AEFE promotional messaging program.

If AEFE determines that a promotional SMS subscriber resides in a state where AEFE membership is unavailable, AEFE may discontinue membership-focused promotional messages to that number.

The fact that an individual receives an AEFE message, accesses an AEFE website, or encounters AEFE advertising does not mean that an AEFE membership is available in that person’s state.

Membership eligibility requirements do not eliminate or restrict any communication, privacy, or consumer right that otherwise applies under applicable law.


2. Transactional and Promotional Messaging Are Separate

AEFE may operate different categories of mobile communications.

Consent or authorization relating to a transactional, service, customer-care, or travel-related communication will not automatically be treated as consent to receive marketing or promotional text messages.

Similarly, opting out of promotional marketing messages does not necessarily prohibit AEFE from sending a separately authorized, requested, legally permitted, or necessary transactional or service communication.


3. Transactional, Service, and Customer-Care Messages

Depending on your relationship and interactions with AEFE, non-promotional messages may include:

  • Account-registration or account-related notices;

  • Membership administration communications;

  • Membership-service notices;

  • Payment or transaction confirmations;

  • Reservation confirmations;

  • Booking updates;

  • Itinerary information;

  • Travel reminders;

  • Travel-related alerts;

  • Changes to reservations or travel arrangements;

  • Responses to customer-service inquiries;

  • Concierge communications requested or initiated by you;

  • Responses to text messages you send to AEFE;

  • Notifications regarding benefits or travel requests you initiate;

  • Security or account-related notifications;

  • Communications regarding existing transactions;

  • Communications necessary to resolve a customer-service issue; and

  • Other non-promotional communications relating to an existing relationship, request, account, membership, or transaction.

Message frequency for these communications varies based on your activity, bookings, account, travel plans, service requests, and interactions with AEFE.


4. Promotional and Marketing Messages

If you affirmatively opt in to AEFE promotional SMS communications and meet applicable geographic eligibility requirements, AEFE may send recurring marketing messages such as:

  • Travel promotions;

  • Destination inspiration;

  • AEFE membership information;

  • Membership-related offers;

  • Travel-related offers;

  • Promotional Travel Opportunity information;

  • Program announcements;

  • Special offers;

  • Invitations;

  • Travel inspiration;

  • Benefit information;

  • New service or feature announcements; and

  • Other advertising or promotional communications from AEFE.

Message frequency varies.

AEFE seeks to keep promotional content separate from communications treated solely as transactional or service-related unless appropriate marketing consent has been obtained.


5. Eligibility for Promotional SMS

To enroll in AEFE’s membership-focused promotional SMS program, you must:

  1. Be at least 18 years of age;

  2. Be the subscriber, account holder, customary user, or authorized user of the mobile telephone number provided;

  3. Provide accurate enrollment information;

  4. Complete an affirmative opt-in process; and

  5. Reside in a jurisdiction in which the applicable AEFE membership or offering is available.

AEFE may request confirmation of your state of legal residence before or after enrollment.

If your state of residence cannot be reasonably determined, AEFE may request additional eligibility information before sending promotional messages.

AEFE may decline, suspend, or discontinue promotional SMS enrollment if AEFE determines that the subscriber does not meet geographic or other eligibility requirements.


6. Moving to or From an Excluded State

If you enroll in AEFE promotional messaging while residing in an eligible state and later establish legal residence in a state where AEFE memberships are unavailable, you should notify AEFE.

AEFE may discontinue promotional membership-related text messages when it learns that you have become a resident of an excluded state.

Moving to an excluded state does not necessarily prevent AEFE from sending separately authorized or legally permissible transactional or service communications concerning:

  • An existing membership;

  • An existing travel booking;

  • An existing payment or transaction;

  • A customer-service request;

  • A concierge request;

  • A security issue; or

  • Another existing relationship or transaction.

Whether any such communication may be sent will depend on the nature of the message, the applicable consent or authorization, and applicable law.


7. How You May Opt In

Depending on the program, AEFE may permit SMS enrollment through methods such as:

  • Affirmatively selecting an unchecked SMS consent checkbox;

  • Submitting an online form containing a clear SMS consent disclosure and affirmative opt-in mechanism;

  • Texting a designated enrollment keyword to an AEFE telephone number;

  • Scanning a QR code and completing the associated enrollment process;

  • Completing an authorized membership or lead form that contains a separate and affirmative SMS enrollment choice; or

  • Using another method that clearly communicates your affirmative consent to receive the identified category of messages.

Where state-of-residence eligibility has not already been determined, AEFE may request that information before completing promotional SMS enrollment.

Merely entering your mobile telephone number on a lead form, application, travel request, membership registration, checkout page, contact form, or other form does not, by itself, constitute consent to receive promotional text messages.


8. Consent to Automated Marketing Messages

Where required by applicable law, AEFE will obtain prior express written consent before sending promotional or telemarketing messages using technology for which such consent is required.

By affirmatively opting in to an AEFE marketing SMS program, you authorize AEFE to send recurring promotional or marketing text messages to the mobile number you provide, including through automated technology where applicable.

Your consent is limited to the company, messaging program, telephone number, and categories of communications identified through the applicable opt-in disclosure.

Electronic consent may constitute a signature to the extent permitted by applicable law.

AEFE will not treat a preselected checkbox, inactivity, silence, or merely providing a telephone number as affirmative promotional SMS consent.


9. Consent Is Not a Condition of Purchase

Agreement to receive AEFE promotional or marketing text messages is optional.

You are not required to consent to promotional text messages as a condition of purchasing or receiving an AEFE membership, travel service, booking, product, benefit, or other offering.

Declining promotional SMS communications will not, by itself, prevent an otherwise eligible person from purchasing an available AEFE membership or service.


10. Changes in Membership Availability

AEFE may change the jurisdictions in which it offers memberships as legal requirements, registrations, business operations, supplier relationships, or other circumstances change.

AEFE may therefore:

  • Add jurisdictions in which membership becomes available;

  • Discontinue membership availability in a jurisdiction;

  • Modify geographic eligibility for promotional communications; or

  • Suppress promotional communications to residents of jurisdictions where AEFE determines that continued marketing is inappropriate or unavailable.

AEFE will update these SMS Terms when appropriate.

A change in geographic availability does not automatically create new marketing consent.

If additional consent is required before AEFE may send promotional messages following a geographic or program change, AEFE will seek that consent.


11. Message Frequency

Message frequency varies according to the applicable program.

Marketing and Promotional Communications: Recurring message frequency varies according to campaigns, member communications, offers, and subscriber engagement.

Transactional and Service Communications: Frequency varies according to bookings, account activity, travel activity, requests, customer-service interactions, and other actions relating to services you receive or request.

AEFE does not guarantee a specific number of messages unless a particular enrollment disclosure expressly states a fixed frequency.


12. Message and Data Rates

Message and data rates may apply.

Your wireless carrier may charge you for sending or receiving SMS or MMS messages according to your mobile-service agreement.

AEFE does not determine or control fees imposed by your wireless carrier.

Contact your wireless provider if you have questions regarding your messaging or data plan.


13. How to Opt Out or Revoke Consent

You may revoke consent to receive text messages through any reasonable method that clearly communicates that you no longer wish to receive the applicable messages.

You may reply to an AEFE message with:

STOP
QUIT
END
REVOKE
OPT OUT
CANCEL
UNSUBSCRIBE

AEFE will also treat other language as an opt-out request where a reasonable person would understand the communication to mean that you want messages to stop.

Examples include statements such as:

  • “Stop texting me.”

  • “Please remove me from your texts.”

  • “Don’t send me marketing texts.”

  • “Take me off this list.”

  • “Stop all texts.”

You may also communicate a revocation request through another reasonable method made available by AEFE, including customer support.

AEFE will not require you to use only one specific opt-out method where another reasonable method is legally recognized.


14. Scope of an Opt-Out Request

AEFE may operate more than one category of text messaging, including promotional, transactional, customer-service, travel, and account-related communications.

The scope of your opt-out will be determined by the language and context of your request and applicable law.

For example:

  • A clear request to stop marketing texts will stop promotional SMS communications.

  • A clear request to stop all texts will be treated as a request to stop all consent-dependent text messages to the extent required by applicable law.

  • A request made in response to a particular informational or transactional program may apply to that program or category unless the request clearly indicates a broader intent or applicable law requires broader treatment.

Where permitted and reasonably necessary, AEFE may use one non-promotional confirmation message to clarify the scope of an ambiguous revocation request.

AEFE will honor clear revocation requests according to applicable law.


15. Timing of Opt-Out Requests

AEFE seeks to process SMS opt-out requests as promptly as reasonably practicable.

Where applicable federal law requires a revocation request to be honored within a reasonable period not exceeding 10 business days, AEFE will process the request within that legally required period.

AEFE’s operational goal is to suppress automated promotional SMS communications as promptly as reasonably practicable after receiving a valid opt-out request rather than treating the maximum legally permitted processing period as the ordinary processing target.


16. Opt-Out Confirmation

After receiving a valid SMS opt-out request, AEFE may send one final non-promotional text message confirming that the request has been received or processed.

The confirmation message will not contain advertising, marketing, promotional offers, or an attempt to persuade you to remain subscribed.

Where permitted by applicable law, the confirmation may ask you to clarify the scope of the opt-out if you receive multiple categories of messages and your request is ambiguous.
